Permission Policy
All personal information that you provide to engage with Curiouser is protected under the Data Protection Act 1998 and the European Union General Data Protection Regulations. We will handle that information in accordance with our Privacy Policy, which forms part of these Terms and thereby, our contract with you. We must be able to identify you as an individual and your children from the information submitted on your booking form and to that extent, you confirm that your profile information is accurate and that you will keep it up to date.
Assuming then that you are over 18 and are capable of entering into contracts that are legally binding upon you, your booking under these Terms gives rise to a contract between you and us that is indeed binding on both you and us and those that may later inherit the benefit of the contracts that we have formed. You may not transfer or sell your rights under this contract to anybody else nor may you use it as security for anything. Curiouser may have to ‘assign’ the contract that we’ve formed with you to another business (for example, as part of a restructure or if we are acquired by another company) but we will let you know in advance of any such ‘assignment’.
Photo Permission
As part of the Curiouser sign up process, we will ask whether we can take, and use, photos of your child in our Sessions for either internal or external purposes. If you select ‘no’ for both, Curiouser will never store or use any photos in which your child is clearly recognisable. If there is any photo in which your child is visible, we will ensure to blur/block their face so that they cannot be identified.
If you agree to our internal photo permission you therefore give Curiouser the right to take and store photographs of your child on the Curiouser system. These photographs will only be viewed by Curiouser employees and official Curiouser affiliates, and will never be shared externally or to any third parties.
If you agree to our external photo permission you therefore give Curiouser the right to use any photograph of your child in one of our Sessions for any promotional and marketing content. This includes, but is not limited to, social media posts, videos, posters, leaflets and displays at our venue. We reserve the right to re-use these photos as many times as we see fit.
Third Party Photographs
Curiouser’s photo policy is that you are able to take photos of your child in a Session, however no other participant in any capacity. Curiouser reserves the right to prohibit you from taking photographs in our Sessions if there is evidence that other participants have featured in your photographs without the prior consent of their carer. Curiouser is NOT responsible if your child features in a photograph taken by a third party, and it is the responsibility of yourself and the photographer in question to negotiate this. However Curiouser will endeavour to facilitate this discussion where possible.
Our Sessions and Liability
Session Content
All our Curiouser Sessions are delivered by our trained Curiouser representatives and they decide on the content delivered each Session. At Curiouser we’re constantly striving to offer the best experience possible for your children during our Sessions and we’re always working on new content and ideas to improve this experience. This may mean that we occasionally will want to replace or modify content. Curiouser reserves the right under these Terms to add or remove features to our Sessions and we make no guarantees as to the content that each Session may contain. If you’re unhappy with any of the Sessions that a Curiouser representative has delivered or would like to give us feedback about a particular feature being withdrawn then please feel free to contact us at info@Curiouser-family.com and a member of the team will be in touch.
It might be that new activities and content require changes or additions to these Terms or the Privacy Policy, we encourage you to re-read our Terms and Conditions at regular intervals to be aware of these changes.
Independent Classes
Although the majority of Curiouser classes are for both parent and child, we do have some classes that children attend independently. In those classes, Students participate at their own risk and you are obliged to inform Curiouser of any existing injuries or medical conditions that the attending children have on your account. All application forms must have any known medical conditions stated and any changes to such information must be notified to Curiouser through our website/Your Account information.
If a Student is unwell or has an accident requiring emergency treatment, you will be contacted via the emergency contact details provided on your account. The liability of Curiouser and that of its staff is restricted to class time only, and then only to gross negligence.
All of our Session Leaders to be in receipt of Enhanced Clearance via the DBS (Disclosure and Barring Service, formerly Criminal Records Bureau or CRB).
Liability
Consumers enjoy protection under a variety of laws in different jurisdictions around the world and nothing in these Terms is intended to undermine your protection in England and Wales. In English law, it would be unlawful for us to attempt to exclude or limit liability for personal injury or death arising from our negligence, or for any loss you suffer as a result of our fraud. The same applies to any statement we make fraudulently intending you to rely on it in entering into this contract with us.
In addition, WE WILL NOT BE LIABLE OR RESPONSIBLE FOR ANY FAILURE TO PERFORM OR FOR THE DELAY IN THE PERFORMANCE OF ANY OF OUR OBLIGATIONS UNDER THESE TERMS THAT IS CAUSED BY EVENTS THAT ARE BEYOND OUR REASONABLE CONTROL. This might include where a Session is cancelled for illness, injury or another reason beyond our control.
You also need to be aware that viruses can be transmitted via websites. If you want to make sure that your systems are safe from infection, you should run suitable security software because WE HEREBY EXCLUDE LIABILITY FOR ANY VIRUS INFECTION OR OTHER HARM CAUSED TO YOUR SYSTEMS THROUGH YOUR USE OF OUR WEBSITE, OR WHEN FOLLOWING ANY LINKS TO WEBSITES RUN BY THIRD PARTIES.
If we happen to make a statement that turns out to be untrue (whether orally or in writing) prior to your booking, then, unless that statement was made fraudulently by us, we will only be liable to you should that untrue statement result in us breaching these Terms. If it does not, the untrue statement has no impact on our relationship with you save insofar as it may impact on your legal rights as a consumer.
There may come occasions where we choose not to insist on your total compliance with your obligations under these Terms or that, where you’ve breached the Terms, we don’t make use of our rights to take action against you. This does NOT mean, however, that we are waiving those rights. We can take action against you later if we so choose, and at any time during a booking period (or indeed, where necessary, at any time after your booking), we can return to the issue and insist upon your compliance.
Safeguarding Policy
In accordance with the Childcare Act Regulations Curiouser has written the following policy statement on safeguarding children and written procedures to be followed in the event of suspected/allegations of abuse or neglect.
Safeguarding Children and Child Protection
Since children who attend Curiouser are accompanied by an adult carer at all times our responsibility in this area is less so than a crèche or playgroup setting. However, should we be worried about persistent unexplainable marks, cuts or bruises on a child then our first point of call would be to contact Camden Council. They will signpost us to other relevant agencies and undertake initial assessment.
Evidence of abuse/neglect
We acknowledge child abuse can take different forms; when children are suffering from physical, sexual or emotional abuse, or are experiencing neglect, this may be demonstrated through the things they say (direct or indirect disclosure) or through changes in their appearance, their behaviour, or their play.
Where such evidence is apparent, it is the responsibility of the franchisee to make a dated record of the details of the concern and discuss what to do with at Camden Council and follow their advice. In some cases this may mean the police or another agency identified
We take care not to influence the outcome either through the way we speak to children or by asking questions of children.
Allegations of abuse or neglect
Should a child (or adult) tell staff at Curiouser something that we would consider to be abuse or neglect (emotional, sexual or physical) then we should also refer to Camden council, who will signpost us to other relevant agencies and undertake initial assessment.
The same procedure should be followed if a member of Curiouser staff is accused of abuse or neglect in order that the correct channels of investigation can be implemented as soon as possible.

All suspicions and investigations are to be kept confidential and shared only with those who need to know.
